Madras High Court Upholds Service Tax Exemption for Tamil Nadu Civil Supplies Corporation on Scientific Storage Godowns

Court Declares TNCSC a Governmental Authority Eligible for Mega Exemption Notification; Rejects Service Tax Demand on Works Contract Services for Public Distribution System Infrastructure

In a significant judgment dated September 28, 2026, the Madras High Court (Madurai Bench, Division Bench) dismissed the writ appeal filed by the Principal Chief Commissioner of GST and Central Excise, Chennai, affirming the exemption of Tamil Nadu Civil Supplies Corporation (TNCSC) from service tax on works contract services related to the construction of scientific storage godowns. These godowns are used for storing paddy and other agricultural produce procured under the Public Distribution System (PDS).

The case arose when the GST Department demanded service tax, interest, and penalties amounting to over Rs. 2.63 crore from TNCSC for payments made to private contractors for constructing storage godowns during October 2015 to June 2017. TNCSC challenged the demand, claiming exemption under Clauses 12A(a) and 14(d) of the Mega Exemption Notification No. 25/2012-ST issued under the Finance Act, 1994.

The Department contended that TNCSC was not a "governmental authority" entitled to exemption, citing that the corporation did not perform municipal functions as per Article 243W of the Constitution, and argued that the godowns' use for multiple commodities defeated the exemption claim.

Rejecting these contentions, the High Court reiterated established principles that the writ jurisdiction under Article 226 of the Constitution can be exercised even when alternative statutory remedies exist, especially in cases involving pure legal questions and where departmental authorities disregarded binding appellate orders without obtaining interim relief.

The Court held that TNCSC qualifies as a "governmental authority" because:

  • It is established by the Government of Tamil Nadu with over 99% equity participation.
  • It performs functions related to social and economic development planning, safeguarding weaker sections, and urban poverty alleviation, which align with functions entrusted to municipalities under Article 243W and the Twelfth Schedule of the Constitution.
  • Its primary activity involves procuring paddy from farmers, storing it in scientific storage godowns, and distributing food grains under the PDS at subsidized rates, fulfilling a public welfare role rather than commercial purposes.

Further, the Court ruled that the exemption under Clause 14(d) applies as the godowns are constructed specifically as post-harvest storage infrastructure for agricultural produce. The possibility of incidental storage of other commodities does not negate the exemption since the test is the objective, design, and immediate use at the time of construction, not hypothetical future uses.

The Court also emphasized the doctrine of judicial discipline, observing that the subordinate revenue authorities are bound by the decisions of appellate authorities. Since the department had not secured an interim stay against a favorable appellate order for the earlier period, it was bound to comply with it and could not take a contrary view for the subsequent period.

Accordingly, the Madras High Court upheld the single Judge's order quashing the service tax demand and penalties imposed on TNCSC, dismissing the writ appeal filed by the GST Department.

This judgment clarifies the scope of exemption for governmental authorities under the Mega Exemption Notification and reinforces the judicial discipline principle binding subordinate revenue officials to appellate orders. It also underscores the importance of considering the actual functional objectives of entities like TNCSC engaged in public distribution and poverty alleviation schemes.

Statutory provision(s):

Finance Act, 1994; Mega Exemption Notification No. 25/2012-ST Clauses 12A(a), 14(d), and 2(s); Article 226 and Article 243W of the Constitution of India; Sections 69, 73, 75, 76, 77 of Finance Act, 1994; Companies Act, 1956 (Section 25)

Bottom Line:

Service Tax - Mega Exemption Notification No. 25/2012-ST - Tamil Nadu Civil Supplies Corporation held to be a "governmental authority" and entitled to exemption under Clauses 12A(a) and 14(d) in respect of service tax demand on works contract services for construction of scientific storage godowns used for storage of paddy/agricultural produce for Public Distribution System - Writ petition held maintainable despite alternative remedy where issue was purely legal and departmental authority had ignored binding appellate order without stay.
