Thane, Sep 11 A court in Maharashtra’s Thane district has sentenced a 25-year-old man to 10 years of rigorous imprisonment for attempting to murder a businessman’s son over money last year.
In his order, a copy of which was made available on Thursday, Additional Sessions Judge G T Pawar also imposed a fine of Rs 50,000 after holding accused Shahrukh Sadik Shaikh guilty.
According to the prosecution, Shaikh got into a fight with Hussein Khan on March 4, 2025, over some financial matters and threatened to kill him. That evening, Shaikh struck Khan on the head with a spade near a mosque, fracturing his skull.
Relying on the testimony of the victim, medical officers, and “partial eyewitness corroboration”, the court rejected the argument of the defence that the victim sustained injuries due to an accidental fall on the mosque steps.
“In order to constitute an offence under Section 307 IPC [now Section 109 BNS] two elements are essential to be established. First, the intention or knowledge to commit murder. Secondly, the actual act of trying to commit the murder. Thus, it must have both the necessary mens rea and actus reus,” the court said.
The court convicted Shaikh under Section 109 of the Bharatiya Nyaya Sanhita, sentencing him to 10 years of rigorous imprisonment and a fine of Rs 50,000, with an additional six months of rigorous imprisonment in default of payment.
The prosecution was represented by Additional Public Prosecutor Rakhi W Pande, while advocate Nadeem Khan represented Shaikh.
