New Delhi, Jul 27 The National Green Tribunal has directed the Uttar Pradesh Pollution Control Board (UPPCB) to verify allegations that some under-construction projects in Greater Noida are continuing despite closure orders having been issued for violating environmental norms.
A bench of NGT Chairperson Justice Prakash Shrivastava and expert member Afroz Ahmad was hearing a matter regarding the alleged construction projects in Greater Noida in violation of environmental norms, including the environmental impact assessment (EIA) notification, and without obtaining the required consent to establish (CTE) and consent to operate (CTO) from the UPPCB, wherever applicable.
The petition has been filed by BJP leader and former municipal corporator Rajendra Tyagi. Advocate Akash Vashishtha appeared on Tyagi's behalf.
During the hearing, the Greater Noida Industrial Development Authority (GNIDA) informed the tribunal that it is examining details of constructions allegedly carried out in violation of environmental norms and sought four weeks to file a comprehensive report identifying such projects.
Advocate Vashishtha referred to the UPPCB's affidavit dated March 25, which identified five under-construction projects, claiming M/s Ghaziabad & Developers Builders, Bhagwati Developers constructing Dwarka City Colony or Samtel Enclave in Chhapraula village of Greater Noida and M/s Sahara Enclave/City along GT Road in Greater Noida were proceeding with constructions despite closure orders.
"UPPCB is directed to verify and ensure that during the operation of the closure order these projects do not proceed in violation of the closure order. UPPCB is directed to file a report in this regard within four weeks,' the tribunal said in an order dated July 23, made available on Monday.
The matter has been listed for further hearing on September 24.
In its affidavit regarding the five under-construction projects, the UPPCB had said that a closure order and environmental compensation of Rs 21.40 lakh each were imposed on M/s Ghaziabad & Developers Builders, Bhagwati Developers and M/s Sahara Enclave/City.
It said M/s PP Estate was issued a closure order along with environmental compensation of Rs 15 lakh, M/s Escon Pride Villa was issued a closure order and environmental compensation of Rs 10.50 lakh, and M/s Trilok Puram Greens had obtained the required CTE from the UPPCB.
