Patna High Court Orders Inquiry into Unlawful Road Construction on Private Land

District Magistrate Directed to Investigate and Ensure Legal Acquisition and Compensation

In a significant ruling, the Patna High Court has directed the District Magistrate of Bhagalpur to conduct a thorough inquiry into the unauthorized construction of a village road over Raiyati land owned by Uttam Jha. The court has mandated that the District Magistrate personally oversee the investigation and ensure that the legal processes for land acquisition and compensation are duly followed.

The case revolves around a piece of land in Bhawanipur, Bhagalpur, where a road was constructed without acquiring the land or compensating the landowner, Uttam Jha. The petitioner asserted that a clerical error during a 1976 survey misattributed ownership to the State, leading to the unauthorized use of his land. Despite a 2017 appellate court ruling in his favor, recognizing his family's ownership, the construction proceeded without rectifying the error or compensating him.

The court, presided over by Justice Rana Vikram Singh, condemned the state authorities' inaction and lack of response to Jha's repeated representations against the road construction. The judgment highlighted the arbitrary conduct of the district authorities, emphasizing that such actions violated the landowner's statutory rights.

Justice Singh has instructed the District Magistrate to verify all claims using revenue records and court judgments, ensuring that any land acquisition complies with legal procedures. The court stressed the importance of proper acquisition and compensation before any further construction, marking a stern reminder of the legal requirements for public works on private land.

The District Magistrate has been given a three-month deadline to complete the inquiry and issue a reasoned order addressing the petitioner's grievances. This ruling underscores the judiciary's role in safeguarding citizens' property rights against administrative overreach.

Bottom line:-

Raiyati land - Construction of village road without acquisition or compensation - Gross violation of landowner's legal and statutory rights - Directions issued for inquiry and remedial measures.

Statutory provision(s): Land Acquisition Act, Administrative Conduct Principles, Property Rights Laws.
