Patna High Court Quashes Arbitrary Repatriation of University Director

Court Orders Restoration of Dr. Ravindra Kumar Sohane to His Position as Director, Extension Education, Citing Violations of Natural Justice and Statutory Provisions


In a significant judgment, the Patna High Court has quashed the repatriation of Dr. Ravindra Kumar Sohane from his post as Director, Extension Education at Bihar Agricultural University. The court's decision came as a relief to Dr. Sohane, who had challenged the university's orders that shifted him to an alleged equivalent post at Mandan Bharti Krishi College. The court found the university's actions to be arbitrary, discriminatory, and violative of the principles of natural justice.


The legal battle began when Dr. Sohane filed a writ petition challenging office orders dated September 19, 2025, issued by the Bihar Agricultural University. These orders repatriated him from his statutory position as Director, Extension Education, purportedly upon completion of a tenure. Dr. Sohane argued that his appointment in 2011 was not advertised as a tenure post, and therefore, could not be retroactively converted into a tenure appointment based on statutes notified much later in 2017.


Justice Alok Kumar Sinha, presiding over the case, thoroughly examined the statutory framework and the university's prior conduct regarding appointments made before the enforcement of the Bihar Agricultural University Statutes, 2010. The court noted that Dr. Sohane's appointment was substantive and not tenure-based, as the statutes explicitly stated that changes would apply prospectively, not retrospectively.


The court also addressed the university's interpretation and previous actions in similar cases, highlighting inconsistencies and unfair treatment towards Dr. Sohane. It found that the university had previously acknowledged the prospective nature of the tenure statutes in other instances but had arbitrarily departed from this interpretation in Dr. Sohane's case without valid reasons.


Furthermore, the court criticized the university for violating principles of natural justice by failing to provide Dr. Sohane with prior notice or an opportunity for a hearing before altering his service conditions. It emphasized that actions with serious civil consequences necessitate adherence to fairness and due process.


In its judgment, the court ordered the restoration of Dr. Sohane to his position as Director, Extension Education, with all consequential service benefits and continuity of service. The university has been directed to comply with this order within two months.


This ruling underscores the court's commitment to uphold statutory provisions and principles of natural justice, setting a precedent for fair treatment in administrative decisions within educational institutions.
