In a significant ruling, the Patna High Court has upheld the conviction of Binod Kumar and others under Section 323/34 of the Indian Penal Code, in connection with an assault case stemming from a long-standing land dispute. However, the court reduced their sentence to the period already served, acknowledging the mitigating circumstances, including the prior enmity between the parties.


The incident, which occurred on February 27, 2005, involved an altercation where the informant, Rahul Kumar, alleged he was attacked by Binod Kumar with a khanti, and further assaulted by Yogendra Ram with a lathi, causing injuries. The conflict escalated when the informant's mother was also reportedly assaulted.


The appellants challenged their conviction, arguing that the prosecution's case was weak, with only two witnesses, one of whom turned hostile. They claimed the charges were motivated by the ongoing land dispute and village politics. The defense emphasized the respectable backgrounds of the accused, including a retired judicial officer and an advocate.


Despite these arguments, the prosecution maintained that the evidence against the appellants was substantial, leading to their conviction by the trial court. The High Court, in its judgment, confirmed the conviction under Section 323/34 IPC, noting that the evidence from the informant was consistent and credible. However, it found no basis to sustain a conviction under the more severe charge of Section 307 IPC.


Justice Purnendu Singh, while delivering the judgment, acknowledged the evidence of prior enmity but emphasized that it did not undermine the reliability of the informant's testimony. The court concluded that the injuries sustained were not severe enough to warrant a conviction under Section 307 for attempted murder.


Considering the mitigating factors, including the nature of the dispute and the fact that the appellants had already spent significant time in custody, the court decided to reduce their sentence to time served. The appellants were also discharged from their bail bonds, provided they had no other pending liabilities.


This judgment underscores the judiciary's balanced approach in dealing with cases of personal enmity, ensuring justice while considering the broader context of the dispute.
