Patna High Court Upholds Dismissal of Bank Officer for Fraudulent Loan Disbursement

Vinay Verma found guilty of sanctioning loans to fake borrowers; Court emphasizes higher integrity standards for bank officers.

In a significant ruling, the Patna High Court has upheld the dismissal of Vinay Verma, a former officer at the Uttar Bihar Gramin Bank, for his involvement in sanctioning and disbursing loans to non-existent borrowers. The judgment, delivered by Justice Harish Kumar, underscores the importance of integrity and adherence to banking norms by officers in positions of trust.

Vinay Verma, who served as the Branch Manager at the Bithauli Branch of Uttar Bihar Gramin Bank, faced allegations of gross misconduct. The charges included the fraudulent sanctioning of 44 loans under the Joint Liability Kisan Credit Card (JLKCC) scheme to fake borrowers. These allegations were substantiated through documentary evidence and witness testimonies, despite Verma's claims of adherence to the bank's procedures.

The court's decision came after a comprehensive review of the disciplinary proceedings initiated against Verma, which included a detailed inquiry report by an investigation officer. The report highlighted significant discrepancies in the verification of loan applicants, including the use of tampered voter ID cards and the absence of pre-sanction inspections. Despite the defense's attempts to challenge the validity of the proceedings, the court found that the principles of natural justice were upheld throughout the process.

In its judgment, the High Court emphasized that a bank officer must uphold the highest standards of honesty and integrity, given their role in safeguarding public money. The court dismissed the petitioner's claims that no financial loss had been incurred by the bank, noting that the closure of fake accounts precluded any possibility of recovering the disbursed loan amounts.

Justice Kumar stated that judicial intervention in such cases is warranted only if the disciplinary proceedings are inconsistent with natural justice or if findings are based on no evidence. The court reiterated that it is not an appellate authority to re-evaluate evidence or the proportionality of the penalty unless it shocks the conscience of the court.

The decision has been hailed as a reinforcement of accountability and ethical standards within the banking sector, especially at a time when financial institutions are under scrutiny for maintaining the integrity of their operations.

Bottom line:-

Banking Officer charged with sanctioning and disbursing loans to fake borrowers held accountable for gross misconduct. The Court upheld dismissal as punishment, emphasizing that a bank officer is required to maintain higher standards of honesty and integrity.
