In a significant ruling, the Patna High Court has upheld the decision of a Single Judge to quash the dismissal of a Bihar Gramin Bank employee, Madhusudan Prasad Tanti, over alleged caste misrepresentation. The Division Bench, comprising Mr. Sudhir Singh and Ranjan Kumar Jha, found that the disciplinary proceedings against Tanti were unsustainable due to the absence of any competent authority invalidating his caste certificate and a lack of contemporaneous evidence of misrepresentation.
The case revolved around Tanti's employment, which was allegedly secured by misrepresenting his caste as "Pan," a Scheduled Caste, instead of "Tanti," a Backward Class, at the time of his appointment in 1980. A charge-sheet was issued in 1996, accusing Tanti of producing a forged caste certificate to secure a position reserved for Scheduled Castes.
Despite the Inquiry Officer exonerating Tanti in 2009, the Disciplinary Authority disagreed, leading to his dismissal in 2011. The Appellate Authority upheld this decision in 2012. However, the High Court found that the disciplinary proceedings lacked substantive evidence, as Tanti's caste certificate was never canceled or declared invalid by a competent forum.
The court's decision highlighted the interchangeability of "Pan" and "Tanti" in Bihar, as clarified by a 2014 government memo. The judges noted that the employer failed to produce primary evidence, such as original appointment documents, to substantiate the allegations. The court emphasized that fraud must be established by clear and convincing evidence, which was absent in this case.
This ruling reinforces the importance of adhering to due process and the principles of natural justice in disciplinary proceedings. The court dismissed the intra-court appeal by the bank, affirming the Single Judge's decision to reinstate Tanti and grant him all consequential service benefits.
