Punjab and Haryana High Court Grants Bail to Accused in Stolen Vehicle Parts Case

Court emphasizes extended custody period and absence of further investigation needs; denies sole reliance on prior cases to withhold bail under Bharatiya Nagarik Suraksha Sanhita, 2023

In a significant decision dated August 24, 2026, the Punjab and Haryana High Court, presided over by Justice Manisha Batra, granted regular bail to Amrik Singh @ Amrika, accused of receiving a stolen vehicle and selling its parts. The petitioner had been in judicial custody since September 20, 2025, in connection with FIR No. 07 registered at Police Station City Kaithal, District Kaithal under Sections 379 and 411 of the Indian Penal Code.

The case originated when the complainant, Ankur Kansal, reported his Swift car stolen from outside his residence on the night of January 2, 2024. Investigations revealed involvement of multiple accused, with the petitioner allegedly purchasing the stolen vehicle for Rs. 1,00,000 and later selling its parts for Rs. 1,30,000. Despite the serious nature of the offence, the petitioner's counsel argued that the trial would be protracted and the petitioner was not required for further investigation since the chargesheet had already been filed.

The State opposed the bail plea citing the petitioner's extensive criminal record involving over 25 cases and the risk of recidivism. However, the Court observed that previous involvement in other cases cannot be the sole ground for denying bail. Taking into account the long period of custody, the nature of the offence, and the completed investigation, the Court held that the petitioner was entitled to bail.

The Court ordered the release of the petitioner on furnishing personal and surety bonds to the satisfaction of the trial court or concerned magistrate. The ruling highlights the judiciary's balanced approach in upholding the rights of the accused while ensuring the integrity of the investigation and trial process under the provisions of the Bharatiya Nagarik Suraksha Sanhita, 2023.

Bottom Line:

Bail granted to the accused under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023, considering the extended period of custody, the nature of the offence, and absence of further need for investigation despite the accused's involvement in multiple similar cases.

Statutory provision(s):

Bharatiya Nagarik Suraksha Sanhita, 2023 Section 483; Indian Penal Code Sections 379, 411
