Punjab and Haryana High Court Overturns Railway Tribunal's Ruling, Awards Enhanced Compensation

Bona fide Passenger Status and Accidental Fall Established; Compensation Increased to Rs. 8,00,000 with Interest


In a significant judgment, the Punjab and Haryana High Court has overturned the decision of the Railway Claims Tribunal, Chandigarh Bench, which had previously dismissed a compensation claim related to the death of a railway passenger, Jonathan James, in an alleged untoward incident. The High Court's ruling came in the case of "Philips and Anr. v. Union of India," wherein the appellants sought statutory compensation under the Railways Act, 1989, following the tragic demise of Jonathan James.


The Tribunal had originally rejected the claim on the grounds of non-recovery of a valid railway ticket from the deceased and contradictory versions provided by the deceased's father regarding the cause of death. However, the High Court emphasized a liberal interpretation of the Railways Act, which aims to provide expeditious compensation to victims of railway accidents.


The High Court highlighted that the non-recovery of the railway ticket alone does not disprove the deceased's status as a bona fide passenger, as affirmed by the Supreme Court in several precedents, including "Union of India v. Rina Devi." The Court held that the appellants had sufficiently established, on a preponderance of probabilities, that the deceased was indeed a bona fide passenger who met with an accidental fall from the train.


Furthermore, the High Court considered the enhanced compensation rules effective from 01.01.2017 and directed the respondent, Union of India, to pay the revised compensation amount of Rs. 8,00,000 along with 9% interest per annum from the date of the claim petition. The interest rate would increase to 12% if the payment is delayed beyond eight weeks from the receipt of the judgment.


This judgment underscores the judiciary's commitment to ensuring justice and fair compensation for victims of railway accidents, reinforcing the principle of beneficial legislation under the Railways Act.
