Court Rules Ministry of External Affairs' Cryptic Refusal Without Reasons as Arbitrary; Directs Immediate Approval and Protocol Facilitation for Official Visit to SIAL Food Exhibition in Paris
In a significant judgment delivered on October 16, 2026, the Punjab and Haryana High Court quashed the Ministry of External Affairs' denial of political clearance to the Punjab Chief Minister's delegation headed for the Salon International de l'Alimentation (SIAL) food exhibition in Paris, France. The court held that the refusal conveyed merely as being "declined from political angle" without any stated reasons was arbitrary and unsustainable under administrative law principles.
The case arose when the Punjab government sought political clearance for a high-level delegation comprising the Chief Minister Bhagwant Mann, the Chief Secretary, and the Principal Secretary to the Chief Minister to attend the international food industry trade show scheduled from October 17 to 21, 2026. The visit aimed to promote exports, investment opportunities, and international trade linkages for Punjab's agricultural and processed food products, especially through MARKFED, Punjab's apex cooperative and one of Asia's largest, with a global presence.
Despite all procedural formalities being followed, including the submission of a detailed application on the Ministry's e-Pol Clearance System and confirmation from the Agricultural and Processed Food Products Export Development Authority (APEDA) of MARKFED's participation, the Ministry declined clearance on October 12, 2026, without furnishing any substantive reasons. The Ministry's affidavit later cited security concerns, lack of a bilateral invitation, and absence of a functional role for the Chief Minister as justifications. However, the court applied the precedent established in Mohinder Singh Gill v. Chief Election Commissioner (1978 AIR SC 851), underscoring that administrative orders must be judged by the reasons stated therein and cannot be supplemented post hoc by affidavits.
The court observed that the Chief Minister had a clear functional role as head of the delegation, and the invitation by SIAL under the patronage of the President of the French Republic confirmed the legitimacy of the visit. It also noted the absence of any explanation for the vague "political angle" reason and rejected the Ministry's post facto justifications. The court emphasized that denial of political clearance at the eleventh hour was prejudicial and could harm Punjab's economic interests by obstructing efforts to promote agricultural exports and international trade.
Concluding the hearing, Justice Tribhuvan Dahiya allowed the writ petition, set aside the refusal order, and directed the Ministry of External Affairs to urgently grant political clearance, facilitate departure, and extend all due protocols for the delegation's official visit to France as per the itinerary.
The ruling reinforces the requirement for transparency and reasoned administrative action in matters of political clearance for foreign visits by state dignitaries, balancing diplomatic concerns with the developmental imperatives of states.
Bottom Line:
Administrative law - Political clearance for foreign visit of State delegation cannot be denied by a cryptic order stating only that clearance is declined "from political angle" - Order without reasons is arbitrary and cannot be sustained - Reasons cannot be supplemented later through affidavit in view of Mohinder Singh Gill - High Court set aside denial of political clearance to Punjab delegation led by Chief Minister for visit to France for trade promotion and directed urgent approval.
