Rajasthan High Court Upholds Withholding of 10% Pension of Retired Police Officials for Grave Negligence in Law and Order Incident

Court Rules Departmental Proceedings Initiated Before Retirement Can Continue Post-Retirement; Pension Can Be Withheld for Grave Misconduct Even Without Pecuniary Loss

In a significant verdict delivered on October 1, 2026, the Rajasthan High Court (Jaipur Bench) dismissed the writ petition filed by retired police officials challenging the order of withholding 10% of their pension for life. The petitioners, including Iftkharuddin and others, had faced departmental proceedings alleging grave negligence in the discharge of their official duties related to a violent mob incident in 2011, which culminated in the death of a Sub-Inspector.

The court upheld the disciplinary authority's decision dated March 23, 2026, which imposed the penalty after the petitioners' retirement, holding that departmental proceedings initiated before retirement can validly continue and conclude after retirement under Rule 7 of the Rajasthan Civil Services (Pension) Rules, 1996. The bench, presided over by Justice Anoop Kumar Dhand, emphasized that the sanction of the Governor for initiating proceedings post-retirement was not required in this case, as the charge-sheet was served while the officials were still in service.

The case stemmed from an incident on March 17, 2011, where the petitioners allegedly fled from the scene during a protest triggered by a murder, resulting in the violent mob attacking and burning a Sub-Inspector alive and damaging government property. Although the enquiry officer initially exonerated the petitioners in a departmental enquiry report dated July 5, 2019, the disciplinary authority disagreed with the findings after a detailed review. The authority issued a disagreement note in 2025, recorded reasons charge-wise, and considered the explanations submitted by the petitioners before passing the impugned order.

The petitioners argued that withholding pension requires proof of grave misconduct or pecuniary loss and that the delay of over six years in imposing the penalty and lack of Governor's sanction violated procedural norms. However, the court rejected these contentions, holding that grave negligence alone, even without pecuniary loss, justified withholding pension. The court also found that the disciplinary authority complied fully with procedural requirements under the Rajasthan Civil Services (Classification, Control & Appeal) Rules, 1958, including recording reasons for disagreement with the enquiry report.

The judgment reiterates the principle that pension rights are not absolute and can be withheld or withdrawn if the pensioner is found guilty of grave misconduct or negligence during service, safeguarding public interest and governmental integrity. The court further noted that the Rajasthan Public Service Commission was consulted before passing the final order, fulfilling the statutory requirement.

This ruling affirms that disciplinary processes started during service cannot be stalled or nullified by retirement and that pension penalties are an effective tool for accountability in public service.

Bottom Line:

Pension - Departmental proceedings initiated before retirement can continue after retirement and be treated as proceedings under Rule 7 of the Rajasthan Civil Services (Pension) Rules, 1996 - Pension can be withheld on proof of grave misconduct or negligence even if no pecuniary loss is caused to Government - Where disciplinary authority disagrees with exoneration report and records reasons charge-wise, penalty of withholding 10% pension for lifetime is valid.
