Priyanka Das to receive enhanced compensation for permanent physical impairment following a tragic motorcycle accident.
In a landmark decision, the Supreme Court of India has awarded a compensation of Rs. 3,77,84,297 to Priyanka Das, who suffered 100% permanent physical impairment in a motorcycle accident. The judgment, delivered by Justices S.V.N. Bhatti and N.V. Anjaria, marks a significant shift in the assessment of compensation for accident victims, emphasizing the importance of considering total functional disability and loss of earning capacity in the open labor market.
The case originated from a tragic accident on April 10, 2011, when a truck collided with a motorcycle carrying Priyanka Das and Sushant Prabhakaran, resulting in Sushant's death and Priyanka's severe injuries, including cortical blindness and the need for a permanent colostomy. Initially, the Motor Accident Claims Tribunal (MACT) had assessed Priyanka's functional disability at 60%, awarding her Rs. 1.35 crores. The Punjab and Haryana High Court later revised this assessment to 80%, raising the compensation to Rs. 2.94 crores.
However, the Supreme Court, upon reevaluating the case and considering the latest medical assessments, acknowledged Priyanka's condition as 100% permanent physical impairment. The Court noted that Priyanka's ability to secure and sustain employment independently was completely extinguished due to her disabilities. Consequently, the Court awarded her compensation based on a 100% functional disability assessment.
The detailed judgment considered various factors, including loss of future earning capacity, medical expenses, attendant charges, and loss of marriage prospects. The Supreme Court applied a standardized multiplier of 16, based on Priyanka's age, and factored in a 50% enhancement for future prospects, resulting in a comprehensive compensation package.
