Pending Cases Not Grounds for Disqualification; Court Upholds Fundamental Rights


In a landmark decision, the Telangana High Court, under the stewardship of Justice Surepalli Nanda, ruled in favor of Dr. Peddeli David, who had been denied a hall ticket to appear for the examination for the post of Chairperson of the Child Welfare Committee (CWC) due to a pending case under the Juvenile Justice Act, 2015. The judgment, dated June 23, 2026, asserted that a pending case is not a valid criterion for disqualification, reinforcing that only those with convictions are disqualified under Section 27 of the Act.


Dr. Peddeli David, previously appointed as a member of the Child Welfare Committee for Adilabad District, had applied for the Chairperson position. However, the application process was stalled when the authorities refused to issue a hall ticket, citing an admission of guilt in misuse of power under the Juvenile Justice Act. The petitioner contended that no such admission was made, leading to a legal challenge.


The Court's interim order, dated April 17, 2026, granted Dr. David the right to sit for the exam while withholding the declaration of results, citing the fundamental presumption of innocence until proven guilty, as outlined in the 2013 Supreme Court case of Sumit Mehta v. State of NCT of Delhi. This stance was pivotal in the final ruling, which directed the respondents to release the examination results immediately, ensuring adherence to legal provisions and justice.


The decision underscores the judiciary's commitment to uphold fundamental rights, particularly the right to liberty guaranteed under Article 21 of the Constitution of India. It further emphasizes the principle that an accused remains innocent until proven guilty, thereby protecting individuals from unjust disqualification due to pending legal proceedings.


Bottom line:-

Juvenile Justice Act, 2015 - Pending case under the Act is not a criterion for disqualification of a candidate, only convicted candidates are eligible for disqualification.
