Court Directs Authorities to Recommence Proceedings, Addressing Delays and Procedural Oversights in Land Acquisition for Yadadri Temple Development

In a significant ruling, the Telangana High Court has set aside the final award concerning the land acquisition for the development of the Yadadri Sri Lakshmi Narasimha Swamy Temple, citing procedural lapses in considering objections from landowners. The judgment, delivered by Justice N.V. Shravan Kumar, mandates the recommencement of acquisition proceedings from the stage of hearing objections, emphasizing the necessity of adhering to prescribed timelines under the Right to Fair Compensation and Transparency in Land Acquisition, Rehabilitation and Resettlement Act, 2013 (RFCTLARR Act).


The case involved petitioners Bogi Balraj and others, who challenged the acquisition process on grounds of procedural violations and delays. The petitioners argued that their objections, submitted within statutory and extended timelines, were not duly considered by the authorities. The court concurred, finding that both sets of objections filed by the petitioners were ignored in the final award process.


Highlighting the constitutional right to property under Article 300-A, the court underscored the state's duty to conduct land acquisition efficiently and within statutory timelines. It noted that the failure to adhere to these timelines renders the process susceptible to legal challenge, reinforcing the constitutional safeguards against arbitrary state action.


The judgment orders the authorities to reassess the petitioners' objections, initially submitted on September 29, 2021, and November 15, 2022, and to consider the accompanying documents proving title and possession. The court emphasized the importance of a fair hearing and directed that a general award be passed in accordance with the law, allowing petitioners to seek remedies if dissatisfied with the compensation.


The court further clarified that other landowners who have accepted compensation and seek enhancement under Section 64 of the RFCTLARR Act may pursue legal remedies as per their entitlement.


This ruling highlights the judiciary's role in ensuring procedural fairness and adherence to statutory requirements in land acquisition processes, balancing developmental needs with individual property rights.
