Court Directs Authorities to Adhere to Legal Procedures and Compensate Affected Landowners in Khanamet Village Dispute

The case arose when petitioners Yarala Narasimha Reddy and others challenged the HMDA's actions to demolish structures and convert a 30 feet road into an 80/120 feet road without proper legal procedures. The petitioners, owners of plots in the sanctioned layout by the Survey of India Cooperative Housing Society Ltd, argued that the road expansion plans by HMDA infringed upon their property rights without prior notice or compensation.


The court's ruling underscored the necessity for urban development authorities to comply with legal provisions, including issuing notices and determining compensation before affecting property rights. Justice Rao ordered the HMDA and related authorities to demarcate the affected land, conduct surveys with prior intimation to the petitioners, and determine compensation in strict accordance with the law.


The judgment also highlighted the ongoing legal proceedings related to the title dispute of the subject property, pending before the Supreme Court of India. While the High Court refrained from adjudicating the title dispute, it reiterated that the petitioners cannot be dispossessed without due process and compensation.


Interim relief was granted earlier, restraining authorities from interfering with the petitioners' possession of their plots. The final order reinforced the need for compliance with statutory procedures, ensuring the protection of individual property rights.


This ruling is a crucial reminder for urban development authorities to respect legal mandates and property rights while implementing infrastructure projects.
