Ensuring Jurisdictional Integrity and Smooth Prosecution, Cases Against Forest Officials Transferred to Dehradun CBI Court

The cases, originally being heard in the Court of the Special Judge, P.C. Act, Kumaon Region, Haldwani, involve serious allegations against several high-ranking forest officials, including the then Director of Corbett Tiger Reserve and several Deputy Conservators of Forests. The officials are accused of offenses under multiple statutes, including the Indian Penal Code, the Prevention of Corruption Act, the Forest (Conservation) Act, and the Wildlife (Protection) Act.
The CBI, represented by Mr. Piyush Garg, argued that the transfer of cases was merely procedural since the charge-sheets had already been filed in the CBI Court at Dehradun. The court concurred, highlighting that the Special Judge, Anti-Corruption, CBI, Dehradun, is the competent authority to preside over cases investigated by the CBI. This transfer is expected to prevent any procedural inconsistencies and jurisdictional conflicts.
The court's decision aligns with earlier orders directing the CBI to re-register the cases under the appropriate statutory provisions, emphasizing the seriousness with which these allegations are being treated. The accused include senior forest officials such as Shri Kishan Chand, Shri Brij Bihari Sharma, and Shri Rahul, among others, who held crucial positions in the Kalagarh Tiger Reserve Division and Corbett Tiger Reserve. They face charges of corruption, forgery, and violations of forest and wildlife protection laws, reflecting the gravity of the alleged offenses.
The court, presided over by Justice Siddhartha Sah, has thus facilitated the smooth transition of these cases to the designated CBI Court, where they will be handled in accordance with legal norms and standards.
