Court mandates fresh review of fire safety compliance, urging scrutiny of unauthorized constructions in Dehradun housing complex
Dehradun, July 1, 2026: In a significant judgment, the Uttarakhand High Court has set aside an order by the District Magistrate, Dehradun, which directed the Chief Fire Officer to issue a No Objection Certificate (NOC) to Pinnacle Residency Apartments despite unauthorized constructions obstructing fire safety measures. The court emphasized the paramount importance of fire safety compliance in residential complexes and called for a fresh decision after thorough scrutiny by statutory authorities.
The judgment came in response to a writ petition filed by the Pinnacle Residency Apartments Owners Association, which raised concerns over unauthorized constructions by the builder, M/s Disha Hospitality Pvt. Limited, that compromised fire safety access. The petitioner argued that these constructions violated the building plan approved by the Mussoorie Dehradun Development Authority (MDDA) and failed to meet the fire safety norms prescribed under the Uttarakhand Fire & Emergency Service, Fire Prevention and Fire Safety Act, 2016.
Earlier, the District Magistrate had allowed the appeal of the builder, dismissing the objections raised by the Chief Fire Officer regarding fire safety deficiencies. The High Court, however, found that the District Magistrate's decision was based on outdated NOCs issued during the project planning stage and did not consider the unauthorized structures erected thereafter. The court stressed that such NOCs cannot validate subsequent constructions that endanger residents' safety.
Justice Manoj Kumar Tiwari, presiding over the case, highlighted the role of statutory authorities in ensuring accessibility for fire tenders and equipment during emergencies. He criticized the District Magistrate for relying on video evidence produced by the builder without expert assessment or site inspection, deeming it insufficient for determining compliance with fire safety norms.
The court observed that the video in question was inadequate to establish that fire tenders could effectively access the complex in case of an emergency. It underscored the necessity for a fire safety audit by domain experts, emphasizing that authenticity and expert assessment are crucial before accepting such evidence.
In setting aside the District Magistrate’s order, the High Court has remitted the matter for a fresh decision, mandating that all necessary parties be heard and compliance with fire safety standards be objectively assessed. This decision is a reminder of the judiciary's role in safeguarding public safety and ensuring adherence to statutory norms.
Residents of Pinnacle Residency, comprising 86 apartments in high-rise buildings, have welcomed the judgment, expressing relief over the court’s insistence on stringent fire safety measures. They hope the renewed scrutiny will lead to safer living conditions and adherence to legal standards.
