Court Dismisses Petition Challenging Eligibility of Newly Appointed Vice-Chancellor


In a significant ruling, the Uttarakhand High Court has upheld the appointment of Dr. Uttam Kumar Sharma as the Vice-Chancellor of Uttarakhand Ayurved University, dismissing petitions that questioned his eligibility for the position. The verdict, delivered by a division bench comprising Chief Justice Manoj Kumar Gupta and Justice Subhash Upadhyay, concluded that Dr. Sharma possessed the requisite qualifications as per the University Grants Commission (UGC) Regulations, 2018, and the Uttarakhand Ayurved University Act, 2009.


The petitioners, who include a social activist and a journalist, had filed writ petitions seeking a writ of quo warranto against Dr. Sharma's appointment. They argued that Dr. Sharma's experience as a Principal, which they claimed was a non-teaching role, should not be counted towards the experience required for the Vice-Chancellor position. However, the court found that the role of a Principal, under the Uttarakhand (Ayush Ayurvedic College Teachers) Service Rules, 2011, inherently includes teaching responsibilities, thereby validating Dr. Sharma's qualifications.


Further, the court emphasized the principle of judicial restraint in academic matters, highlighting that the courts should not interfere with the decisions made by expert committees unless there is evidence of malafide intent or procedural irregularities. The court noted that the Selection Committee, constituted as per the statutory provisions, had duly evaluated Dr. Sharma's qualifications and experience, and there was no evidence of any malafide actions by the committee.


Referring to a comprehensive list of precedents, the court reiterated the legal position that academic decisions should be left to experts and that courts should refrain from acting as appellate bodies in such matters. The judgment also distinguished the present case from other cited cases, highlighting that the procedural requirements for the appointment, including public notification and proper evaluation by a Search-cum-Selection Committee, were duly followed.


The court also dismissed the petitioners' reliance on previous judgments, noting that each case has unique facts and circumstances. The bench concluded that the appointment process was in strict adherence to the relevant UGC regulations and the university's statutory framework, affirming Dr. Sharma's position as Vice-Chancellor.


The dismissal of the petitions underscores the judiciary's deference to expert bodies in academic appointments, reinforcing the autonomy of educational institutions in making such decisions. The ruling is expected to set a precedent for future challenges to academic appointments, emphasizing the importance of following established procedures and respecting the expertise of selection committees.
