Uttarakhand High Court Upholds Family Court's Decision to Restore Cross-Examination Opportunity

Family Court's discretion affirmed to ensure fair trial and substantive justice in matrimonial dispute.


In a significant ruling, the Uttarakhand High Court has upheld the decision of the Family Court in Vikasnagar, District Dehradun, to restore the opportunity for cross-examination in a pending divorce case, emphasizing the principles of substantial justice over procedural technicalities. The division bench comprising Mr. Manoj Kumar Tiwari and Mr. Pankaj Purohit delivered the judgment on June 4, 2026, in the case of Santosh Kumar v. Sangeeta Rani.


The case revolves around a divorce suit filed in 2021, where the respondent, Sangeeta Rani, was required to undergo cross-examination. Despite multiple opportunities, the cross-examination could not proceed, leading to the closure of this opportunity by the Family Court in August 2024. An initial application to restore this opportunity was rejected later that month, and the proceedings moved towards a final hearing.


However, the respondent filed another application in early 2026, seeking restoration of the cross-examination opportunity. The Family Court allowed this application on February 5, 2026, subject to a cost of Rs. 1,000. This decision was challenged by the appellant, Santosh Kumar, who argued that the Family Court’s decision was procedurally flawed and delayed the proceedings unduly.


The High Court, however, found that the Family Court's decision was procedural and did not determine the substantive rights of the parties. The judgment underscored that Family Courts should prioritize substantive justice and ensure disputes are resolved on merits. The court noted that denying the opportunity for cross-examination could result in an unfair trial, whereas granting it did not cause irreversible harm to the appellant, especially as the costs imposed compensated for any inconvenience.


The High Court’s decision highlights the judiciary’s commitment to ensuring fair trials by allowing adequate opportunities for both parties to present and challenge evidence, reinforcing the principle that procedural rules should not overshadow the pursuit of justice.
