Woman gym trainer hit by ST bus gets Rs 22.62 lakh as compensation from MACT

Thane, Jul 24 The Motor Accident Claims Tribunal (MACT) in Thane has awarded compensation of Rs 22.62 lakh to a gym trainer who suffered 20 per cent functional disability after being hit by a Maharashtra State Road Transport Corporation (MSRTC) bus in 2020.


The accident took place on October 19 that year when the claimant, 38-year-old Nalini Pravin Kamthe, was riding her two-wheeler near Hari Om Nagar police outpost towards Mumbai. The speeding MSRTC bus struck her vehicle from behind, causing her severe fracture and head injuries.


Rejecting MSRTC's argument of contributory negligence, the tribunal said, "The driver of offending ST bus was the person having last opportunity to avoid accident. There is nothing on record to show any contributory negligence on the part of claimant."


The MACT assessed her functional disability at 20 per cent after observing there is no any reliable evidence to show the working capacity of the claimant has been reduced to the extent of 50 per cent.


The awarded sum includes compensation for loss of future earnings, medical expenses, medicine costs, future surgeries, pain and suffering, special diet, and conveyance.
