88-year-old woman gets HC protection to enter her property in Keralam

Kochi, Aug 21 The Kerala High Court has directed the police to provide protection to an 88-year-old woman and her authorised representative to enter her property at Taliparamba in Kannur district and carry out repair works.


The interim order was passed by Justice G Girish on August 11 while hearing a petition filed by T V Devi Nair, who has been fighting to gain access to the property for the past four years.


The court directed the Station House Officer of Taliparamba Police Station and the Superintendent of Police, Kannur Rural, to provide adequate protection when Nair or her representative visits the property, after informing the police in advance.


The property includes a house and a shop facing Muyyam Airport Road at Trichambaram in Taliparamba.


A court had earlier ruled in favour of Nair in a dispute over the property.


According to her petition, the front portion of the property, including the main entrance and veranda, was occupied and blocked by people from the other side of the dispute.


Nair moved to Mumbai for medical treatment after suffering an injury in a fall during the Covid-19 pandemic.


When her representative returned to the property in June 2022, the main entrance was allegedly blocked by walls and an unauthorised shed.


Municipal authorities demolished the outer wall facing the road on October 30, 2025, following an earlier court direction.


However, the petitioner said that structures inside the property continued to block the main entrance.


Nair also alleged that some government records relating to the dispute, including an inspection report prepared in March 2023, had been suppressed.


She further alleged that her authorised representative was physically assaulted and that she faced pressure to sell the property at a price below its market value.


During the August 11 hearing, the Taliparamba Station House Officer told the court that police would provide full protection to Nair whenever required.


The Public Prosecutor also assured the court that necessary action would be taken by the authorities.


The court took note of complaints pending under Section 152 of the Bharatiya Nagarik Suraksha Sanhita (BNSS) (empowering an executive magistrate to issue a conditional order for removal of nuisance) and directed the state counsel to obtain instructions on the matter before the next hearing on August 31.
