Blue Cross Laboratories Secures Legal Victory Against Alto Healthcare for Deceptive Trademark Similarity


In a significant ruling, the Bombay High Court has issued a permanent injunction against Alto Healthcare Private Limited, finding them guilty of trademark and copyright infringement against Blue Cross Laboratories Private Limited. The case, adjudicated by Mr. Arif Doctor, J., centered around the deceptive similarity of Alto Healthcare's product 'MEFIAL-SPAS' to Blue Cross's established trademarks 'MEFTAL' and 'MEFTAL-SPAS'.


Blue Cross Laboratories, represented by Mr. Siddhant Gupta and his team, successfully argued that their registered trademarks and artistic works were blatantly copied by the defendants, leading to confusion among consumers. The court noted that Alto Healthcare imitated the entire packaging and artistic work of Blue Cross's products, merely altering one letter in the trademark.


The judgment emphasized the phonetic and visual similarities that could mislead the public, thereby infringing upon Blue Cross's established goodwill. The court imposed compensatory costs of Rs. 5,00,000/- on each defendant for their dishonest conduct and negligence, highlighting the importance of protecting intellectual property rights in the pharmaceutical sector.


While Blue Cross's claim for damages was denied due to a lack of evidence, the court's decision reinforces the critical role of trademarks and copyrights in maintaining business integrity and consumer trust.
