New Delhi, May 29 A Delhi court has granted bail to a man accused of possessing illegal firearms and ammunition, saying that his continued incarceration would serve no further purpose as investigation against him was complete.
Additional Sessions Judge Charu Aggarwal was hearing the bail plea filed by Abu Talib, accused in a case related to possession and supply of illegal arms and ammunition.
In an order dated May 25, the court said, "It is not disputed that investigation qua the applicant is completed, therefore, his continued incarceration would serve no further purpose."
According to the prosecution, a raid was conducted at Abu Talib's house in Shahdara on April 14 following secret information regarding his alleged involvement in possession and supply of illegal arms.
Police claimed that during the raid, two pistols with magazines, one country-made pistol, 23 live cartridges and 11 empty cartridges were recovered from his possession.
The prosecution further alleged that during interrogation, Talib disclosed the name of one Monty, from whom he had allegedly procured the weapons.
Opposing the bail plea, the prosecution argued that a huge quantity of arms and ammunition was recovered from the accused and investigation regarding co-accused Monty was still pending. It also informed the court that Talib was involved in two other criminal cases.
The defence, however, claimed that the accused had been falsely implicated and contended that the present FIR was a "counterblast" to another case lodged earlier at the instance of Talib and his uncle against five persons for allegedly firing at their house.
The defence also relied on CCTV footage to allege false implication and planting of case property.
The judge noted that in the FIRs of 2020 and 2026 referred to by the prosecution, the applicant was a victim and not an accused.
The court directed Talib to furnish a personal bond of Rs 25,000 with one surety of the like amount and imposed conditions including regular appearance before the trial court and restriction on contacting prosecution witnesses.
