Gujarat High Court Mandates Arrears for Primary Teachers, Addressing Pay Disparity

Court orders payment of arrears to primary teachers from entitlement date to Government Resolution, rectifying long-standing inequality in pay scales.


In a significant ruling, the Gujarat High Court has directed the State of Gujarat to pay arrears to primary teachers who were denied the higher grade pay scale during the period between their entitlement and the issuance of a Government Resolution. The judgment, delivered by Justice Nirzar S. Desai, addresses the grievances of primary teachers who have been battling for fair compensation since they completed nine years of service.


The case, titled "Gopiben Bhagvanbhai Patel & Ors. vs. State of Gujarat & Ors.," involved primary teachers appointed in Botad District. Despite their eligibility for a higher pay scale after nine years of service, the State had delayed granting them this benefit until the Government Resolution on October 12, 2022. However, the arrears for the period from their eligibility to the date of this resolution were not paid, prompting the legal challenge.


The Court found that the denial of arrears violated the intent of the Government Resolution, which aimed to rectify pay anomalies among primary teachers across municipal school boards. The judgment emphasized that the resolution sought to eliminate disparities in pay scales that arose due to the absence of promotional posts like Education Inspector in certain school boards.


The High Court dismissed arguments from the State regarding delays in filing the petitions and the unavailability of promotional posts as justifications for denying arrears. It ruled that these objections were unfounded and instructed the State to calculate and disburse the arrears within 12 weeks, ensuring that the teachers receive their due compensation without interest.


This ruling is expected to bring relief to many primary teachers who have faced financial disparities due to systemic anomalies. It underscores the judiciary's role in upholding equitable treatment in public service employment, sending a clear message against perpetuating inequalities.


Bottom line:-

Primary teachers entitled to arrears of higher grade pay scale from the date of entitlement to the date of the Government Resolution, irrespective of the availability of promotional posts in the school board.
