Prusottam Swaroop to Refund Rs. 38.97 Lakh with Interest to Umesh Kumar Sahu, Denies Additional Compensation


In a significant judgment, the Patna High Court, presided over by Justice Jitendra Kumar, has ruled in favor of the appellant, Prusottam Swaroop, in a case involving a disputed real estate transaction with Umesh Kumar Sahu. The court overturned the trial court's decision to award full compensation to the respondent while denying the specific performance of the contract.


The case originated from a contract for the sale of a property valued at Rs. 1.55 crore, where the respondent, Umesh Kumar Sahu, had sought the execution of a sale deed or, alternatively, a refund of the advance payment with interest. The trial court had partially decreed the suit, ordering the refund of Rs. 43.30 lakh with 9% interest and an additional Rs. 5 lakh as compensation. However, the execution of the sale deed was denied.


The High Court found that Sahu had failed to fulfill his contractual obligations, specifically the timely payment of Rs. 25 lakh, which was crucial for the seller to clear encumbrances on the property. Consequently, the court ruled that Sahu was not entitled to the equitable relief of specific performance under Section 16(c) of the Specific Relief Act, 1963.


Justice Kumar emphasized that the terms of the contract allowed Swaroop to deduct 10% of the advance payment due to Sahu's default. The court ordered Swaroop to refund Rs. 38.97 lakh, after deducting 10%, with interest at 6% per annum from December 23, 2010, with a provision for penal interest at 12% per annum if not paid within two months.


This ruling underscores the importance of adhering to contractual terms and the limitations of seeking specific performance when essential conditions are unmet.
