Allahabad HC disposes of petition challenging notice to demolish Mustafa Masjid in Moradabad

Prayagraj (UP), Oct 1 The Allahabad High Court has disposed of a writ petition challenging a notice issued for the demolition of Mustafa Masjid at Mohalla Idgah in Moradabad district of Uttar Pradesh.


On September 28, when the matter was taken up before the bench of Justice Siddhartha Varma and Justice Kunal Ravi Singh, it was informed by senior advocate M C Chaturvedi that the impugned notice was withdrawn by the concerned Authority as it was defective, and a fresh notice will be issued in accordance with law.


The court disposed of the petition on the senior advocate's statement.


The writ petition was filed by Zeeshan Ahmad Fareed with the prayer to quash the show-cause notice dated August 21 issued by the Moradabad Development Authority under Section 27(1) of the Uttar Pradesh Urban Planning and Development Act, 1973.


It pleaded that a direction be issued to the Authority not to demolish or seal Mustafa Masjid at Mohalla Idgah and not to disconnect its electricity or water supply, or to take any other coercive step in respect of it.
