Court holds sale deed executed during pendency of Urban Land (Ceiling and Regulation) Act proceedings invalid; petition dismissed on grounds of delay and lack of title


In a significant ruling dated September 14, 2026, the Allahabad High Court (Division Bench comprising Justices Saral Srivastava and Sudhanshu Chauhan) dismissed the writ petition filed by Wood Row School Society challenging the proceedings initiated under the Urban Land (Ceiling and Regulation) Act, 1976, relating to a disputed 4021.26 sq m land parcel in Village Jagatpur Lala Begum, District Bareilly. The Society had sought to quash the proceedings against the original landholder Mohd. Kamar and assert its title and possession over the land based on a registered sale deed dated November 10, 1987.


The Court examined the statutory framework of the Urban Land (Ceiling and Regulation) Act, 1976 (hereinafter “the Act, 1976”), particularly focusing on Sections 10(1), 10(3), and 10(4), which regulate notifications declaring surplus land and prohibit transfers during certain periods. The land in question was declared “vacant surplus” under Section 8(4) of the Act in 1982. After the notification under Section 10(1) was issued in December 1982, but before the declaration under Section 10(3) in December 1989, the petitioner society executed a sale deed for the disputed land.


Relying on clear statutory language, the Court held that any transfer of surplus vacant land during this interim period is “null and void” as per Section 10(4) of the Act, 1976. The society’s plea that the sale deed was valid because notices under Section 26 (requiring prior intimation to the competent authority before transfer of vacant land) were given, was accepted only in respect of 1500 sq m of land falling within ceiling limits. However, the sale deed covering the surplus 4021.26 sq m land was invalid.


The Court further considered the effect of the Urban Land (Ceiling and Regulation) Repeal Act, 1999, which repealed the 1976 Act. It was held, following Section 6 of the General Clauses Act, 1897, that the repeal does not revive any sale deed or transfer deemed void under the repealed Act, nor does it affect previous operations or rights.


Addressing the petitioner’s delay in challenging the proceedings, the Court noted that the petitioner had knowledge of the land ceiling proceedings since the 1980s, as reflected in the sale deed and other documents. The petition filed in 2024, more than 37 years after the sale deed, was therefore dismissed on grounds of delay and laches, emphasizing that the petitioner had no legal title to the disputed land.


The judgment cited precedents including Ritesh Tiwari v. State of UP (2010) and State of UP v. Adarsh Seva Sahkari Samiti Limited (2016), affirming that transfers during the notification period under the Act are void and purchasers cannot derive title from such nullified transactions.


Consequently, all reliefs sought by Wood Row School Society—quashing proceedings under the Act, preventing dispossession, and correction of revenue records—were denied. The Court’s decision reinforces the stringent regulatory regime under the Urban Land (Ceiling and Regulation) Act and underscores the importance of compliance with statutory restrictions on transfer of surplus land.
