Allahabad High Court Grants Interim Anticipatory Bail in Alleged False Drug Recovery Case

Court Directs Superintendent of Police, Mathura, for Detailed Affidavit Submission on Allegations

In a significant development, the Allahabad High Court, under the bench of Justice Rajiv Lochan Shukla, has granted interim anticipatory bail to the applicants, Pinku and Naresh Sharma, in a controversial narcotics case. The bail was granted amidst allegations of false recovery of drugs and money by the local police, as evidenced by CCTV footage submitted by the applicants.

The case, registered under the Narcotic Drugs and Psychotropic Substances Act, 1985, involves Sections 21, 22, and 25, and pertains to an incident in Mathura where the police allegedly recovered 358 grams of Alprazolam and Rs.1,95,000 from a vehicle. However, the applicants have presented a supplementary affidavit with CCTV footage that purportedly shows police taking a black bag from their residence, which was later reported as recovered from a vehicle.

The court, in its order dated August 17, 2026, expressed its concerns over the allegations and stated that the evidence prima facie suggests a false implication. The court has called for a detailed affidavit from the Superintendent of Police, Mathura, to address the allegations made by the applicants.

The Learned A.G.A. opposed the bail, citing the serious nature of the recovery and the criminal histories of the applicants. However, the court, considering the presented evidence, decided to grant interim anticipatory bail until the next hearing scheduled for September 1, 2026.

The court imposed strict conditions for the bail, including the applicants' availability for police interrogation, prohibition on leaving India without court permission, and non-interference with the investigation process or witnesses.

This case highlights the critical balance between law enforcement and judicial oversight, especially in cases involving serious charges under the NDPS Act.

Bottom Line :

Anticipatory bail granted on interim basis, subject to conditions, in a case under the Narcotic Drugs and Psychotropic Substances Act, 1985, where prima facie false recovery against applicants was alleged.

Statutory provision(s): Narcotic Drugs and Psychotropic Substances Act, 1985 Sections 21, 22, 25
