Appointment Secured by Forged Documents Declared Void; Court Affirms "Fraud Vitiates All Solemn Acts"
In a landmark decision, the Division Bench of the Allahabad High Court comprising Justices Atul Sreedharan and Vivek Saran has overturned a Single Judge's order, affirming the dismissal of Ranveer Singh from his post as a Bandi Rakshak due to fraudulent procurement of a caste certificate. The court's judgment, delivered on July 17, 2026, emphasized that any appointment obtained through fraudulent means is void ab initio and non-est in the eyes of the law.
The controversy originated when Ranveer Singh was appointed on August 8, 1992, under the Scheduled Tribe reservation. However, a verification process initiated in 2007 revealed that the caste certificate he provided was forged and not issued by any competent authority. Despite Singh's claim that the terms 'Lodh' and 'Lodhi' were synonymous, allowing him to claim Scheduled Tribe status, the court found no evidence to support this assertion.
The High Court's decision underscores the principle that fraud unravels all and that no appointment obtained through deception can withstand judicial scrutiny. The court ruled that Singh's appointment, based on a fraudulent caste certificate, was illegal and non-existent from the outset. Furthermore, the court clarified that in cases of fraud, there is no requirement for detailed disciplinary proceedings prior to dismissal, as the foundational appointment itself is invalid.
The court also criticized the Single Judge for exceeding jurisdiction by delving into caste classification issues, which fall outside the purview of service matters. By setting aside the Single Judge's decision, the Division Bench has reinforced the legal maxim that fraud vitiates all solemn acts, thereby supporting the integrity of public employment processes.
Despite the termination, the court held that the salary and emoluments paid to Singh during the appeal's pendency would not be recovered, acknowledging his service without any interim order.
