Initially, the Motor Accidents Claims Tribunal (MACT) awarded a compensation of Rs. 7,28,000 to the claimants. The A.P.S.R.T.C challenged this award, contesting the findings on negligence and the income assessment of the deceased.
The High Court, presided over by Justice A. Hari Haranadha Sarma, upheld the MACT's findings on negligence, citing the preponderance of probability and relying on evidence including the crime record and witness testimonies. The court also applied precedents from the Supreme Court, particularly focusing on the guidelines for calculating compensation as laid down in cases like Sarla Verma v. Delhi Transport Corporation and National Insurance Co. Ltd. v. Pranay Sethi.
In an important aspect of the judgment, the court emphasized that just and reasonable compensation could be awarded even in the absence of a cross-appeal by the claimants. Referring to precedents such as Nagappa v. Gurudayal Singh and Surekha v. Santosh, the court noted that the appellate court has the authority to enhance compensation to ensure justice for the claimants.
The compensation was recalculated by considering future prospects and conventional heads such as loss of estate and loss of consortium, resulting in an enhanced amount of Rs. 10,06,000, with an interest rate of 6% per annum from the date of the petition.
