Court Orders Respondents to Pay Over Rs. 82 Lakhs for Breach of Injunction in Trademark Dispute
In a landmark decision, the Bombay High Court has imposed exemplary and legal costs totaling over Rs. 82 lakhs on the Respondents, Harichand Nagpal and his son Kamlesh Nagpal, for willful disobedience of an injunction order concerning the unauthorized use of a registered artistic work and trademark. The judgment, delivered by Justice Arif S. Doctor, found the Respondents guilty of contempt for breaching an earlier injunction that prohibited the use of the 'NOVA' trademark and its associated artistic work.
The case originated from a legal dispute between the Applicant, Dr. Ashok M. Bhat, and the Respondents, who were accused of selling counterfeit products using labels deceptively similar to the Applicant's registered 'NOVA' trademark and artistic work. Despite an injunction order dated 24th November 2010, which restrained the Respondents from using the 'NOVA' mark or any similar artistic work, they continued to sell products under the 'NONI' label, which the court found to be virtually identical to the Applicant's registered artistic work.
The court dismissed the Respondents' defenses, which included claims of prior registration and usage of the 'NONI' mark, as irrelevant to the contempt proceedings. Justice Doctor emphasized that the scope of contempt proceedings was limited to determining whether there was a breach of the court order, and any defenses regarding the merits of the initial injunction were not permissible. The judgment highlighted the Respondents' deliberate and calculated attempts to undermine the court's authority by continuing their infringing activities.
In addition to awarding the Applicant legal costs of Rs. 32,42,868, the court imposed exemplary costs of Rs. 50,00,000 on the Respondents. Furthermore, the court ordered the Respondents to disclose, on oath, the complete accounts of sales related to the infringing products and warned that failure to comply could lead to further penalties, including striking off their defense in the ongoing suit.
Justice Doctor's judgment also noted the Respondents' history of infringing activities, referencing previous findings against them for counterfeit sales of other products. The decision underscores the judiciary's commitment to enforcing intellectual property rights and maintaining the integrity of its orders.
