In a recent development, the Bombay High Court has released a reserved matter involving Skoda Auto Volkswagen India Pvt Ltd and the Union of India to be reheard, following the failure to pronounce judgment within the Supreme Court-mandated timeline. The case, concerning indirect taxes, was originally reserved for judgment on April 28, 2025, but due to workload exigencies, the judgment remained undelivered.
According to the order delivered by Justices B.P. Colabawalla and Firdosh P. Pooniwalla, the Supreme Court's guidelines, as laid down in the case of Pila Pahan alias Peela Pahan v. State of Jharkhand (AIR 2026 SC 2966), require that a reserved judgment should be pronounced within three months. If this timeline is not met, the matter must be brought before the Chief Justice for further orders. The court directed that if the judgment still remains undelivered after a two-week extension, the case should be reassigned to another bench.
In compliance with these guidelines, the Bombay High Court has now released the matter, allowing it to be placed before a regular bench for rehearing, as per the roster handling writ petitions related to indirect taxes. To facilitate the transition, the court ordered that the status quo be maintained for four weeks, enabling the petitioner to move the matter to the designated bench.
