Territorial Jurisdiction Takes Precedence Over Leave Granted Under Letters Patent Clause XII
In a significant ruling, the Bombay High Court has affirmed the decision of the Bombay City Civil Court to return a plaint under Order VII Rule 10 of the Civil Procedure Code (CPC) due to lack of territorial jurisdiction. This decision was reached despite the initial grant of leave under Clause XII of the Letters Patent by the High Court. The case involved a suit filed by Nouveau Exports Pvt. Ltd. against Punita Capoor and another, concerning the specific performance of an agreement for the sale of land situated in New Delhi.
The High Court clarified that the grant of leave under Clause XII does not override the territorial jurisdiction requirements mandated by Section 16 of the CPC. The suit, which involved land located outside Mumbai, was initially filed in the High Court due to the pecuniary value exceeding the jurisdiction of the City Civil Court. However, following amendments to the Bombay City Civil Court Act, 1948, which expanded the pecuniary jurisdiction of the City Civil Court, the suit was transferred.
Justice Sharmila U. Deshmukh presided over the case and highlighted that the City Civil Court is empowered to reassess territorial jurisdiction as if the suit was originally instituted before it, as per Section 4A(2) of the Bombay City Civil Court Act. This empowers the City Civil Court to return the plaint if it lacks jurisdiction, irrespective of the leave previously granted by the High Court.
The Court also observed that a suit for land must be filed within the jurisdiction where the property is located, as per Section 16 of the CPC. In this case, since the land was situated in Delhi, the suit should be presented to the appropriate court in Delhi, not Mumbai.
The decision underscores the distinction between procedural jurisdiction granted by the High Court and substantive territorial jurisdiction as governed by the CPC. The ruling serves as a reminder of the paramount importance of territorial jurisdiction, which cannot be bypassed by procedural grants such as Clause XII of the Letters Patent.
The appeal by Nouveau Exports Pvt. Ltd. was dismissed, affirming the City Civil Court's decision to return the plaint for filing in the proper jurisdiction.
