Kolkata, Aug 21 The Calcutta High Court on Friday dismissed a petition by the sister of alleged illegal sand and stone trader Tulu Mondal, challenging an FIR lodged against her in connection with the seizure of gold and cash worth Rs 50 crore.
Petitioner Kabira Khatun's lawyer alleged illegality in the registration of the FIR, claiming that it was lodged after search, seizure and arrest of an accused.
He asserted that the sequence should have been registration of FIR, then arrest and thereafter seizure.
Justice Saugata Bhattacharyya dismissed the petition, holding that this order is governed by a judgment of August 20 in which the court dismissed Mondal's petition, seeking that the FIR against him be quashed.
Khatun's petition challenged an FIR registered at Mohammedbazar police station in Birbhum district in connection with the seizure of gold bars and cash worth around Rs 50 crore from the residence of Mondal's brother in-law Minar.
Police arrested Minar Mondal following the seizures on July 29, while Tulu Mondal, alias Mohammed Nazibuddin, is abroad since May 23.
The FIR was drawn up on July 30 following the seizures.
Justice Bhattacharyya noted that the court had already dismissed a challenge by Tulu Mondal against an identical criminal prosecution based on the FIR, holding that this petition would be governed by the judgment delivered on August 20.
