New Delhi, Aug 21 The Delhi High Court has refused to grant bail to a man, accused of murdering his wife and throwing her chopped body parts in a septic tank, saying the court cannot shut its eyes to the gruesome manner in which the woman was killed.
While dismissing the plea, Justice Girish Kathpalia said delay in trial is a ground for grant of bail but it is not the only ground for giving the relief.
"Of course, delay in trial is a ground for grant of bail. But that is not the only ground. While considering grant or denial of bail, the court cannot shut its eyes to the gruesome manner in which a lady was killed followed by chopping off of her body and throwing her in the septic tank," the high court said in its order passed on Thursday.
According to the prosecution, a case was lodged by the police in 2019. The man himself had gone to the police station confessing that he had killed his wife, chopped off her body into pieces and dumped them in a septic tank.
While the man was being interrogated, a PCR call was received from the victim woman's brother stating that she was killed and her body was recovered from the septic tank. On the basis of this statement, the FIR was registered.
The victim's brother said since his sister gave birth to three daughters, the accused and his family members used to torture her and also demand dowry.
Seeking bail, the man contended that there were vital contradictions in the testimony of the victim's mother and brother.
His counsel stated that the trial was proceeding on a slow pace and urged the court to grant bail.
The prosecutor opposed the plea saying the trial is not slow and the allegations against him disentitle him of bail.
He said the blood-stained weapon allegedly used in chopping off the victim's body and her clothes and jewellery were also recovered and examined forensically.
Considering the circumstances, the court said it does not find it a fit case to grant bail to the accused and dismissed the plea.
