The controversy began after the West Bengal Legislative Assembly elections in 2026, where the AITC emerged as the principal opposition party. Despite a meeting held on May 6, 2026, where AITC members unanimously supported Chattopadhyay as the Leader of Opposition, the Speaker recognized a different faction on June 3, 2026, based on the support of 58 MLAs from the AITC.


The court noted that the Speaker failed to publish or communicate his decision publicly or to the appellant, raising questions of procedural impropriety. The bench has made this decision provisional, pending a detailed hearing before a single judge, thereby maintaining order in the Assembly while upholding democratic principles.


This case underscores the judiciary's role in ensuring constitutional morality and democratic ideals within legislative procedures.
