High Court Clarifies Advisory Role of State Backward Class Commission, Nullifies Binding Recovery Directive in Commercial Dispute
In a significant judgment, the Chhattisgarh High Court has quashed a recovery order issued by the Chhattisgarh State Backward Class Commission in a commercial dispute involving Kamla Motors and a customer. The case, titled Kamla Motors v. State of Chhattisgarh, centered around a commercial transaction dispute where Kamla Motors, through its proprietor Kailash Barmecha, challenged a recovery recommendation made by the Commission. The Commission had directed recovery of Rs. 1,26,500 from Kamla Motors to be paid to a customer who cancelled an agreement for a harvester machine due to financial delays.
Justice Amitendra Kishore Prasad, presiding over the matter, highlighted that the Commission's role as defined under Section 9 of the Adhiniyam, 1995, is primarily advisory. The statutory provision does not endow the Commission with adjudicatory powers akin to a civil court, and its recommendations cannot be treated as binding orders.
The court referenced past judgments, including the Supreme Court ruling in All India Indian Overseas Bank SC and ST Employees Welfare Association v. Union of India, to emphasize that commissions with civil court-like powers for inquiries do not transform into adjudicatory bodies capable of issuing enforceable orders.
The Chhattisgarh High Court's decision reiterates the limited jurisdiction of such commissions in commercial matters and safeguards businesses from unauthorized directives that might arise from misinterpretation of statutory roles. This ruling provides clarity on the jurisdictional boundaries of commissions, reinforcing their role as advisory bodies rather than judicial entities capable of issuing binding decisions.
