Court Emphasizes Gravity of Drug Offenses and Societal Impact Over Procedural Lapses in Arrest
In a significant ruling, the Delhi High Court has dismissed the bail application of Amar Thapa, accused of possessing a commercial quantity of charas, underlining the serious nature of drug-related offenses and their impact on society. The court, presided by Justice Girish Kathpalia, ruled that the twin conditions under Section 37 of the Narcotic Drugs and Psychotropic Substances Act, 1985, must be satisfied for granting bail, which were not met in this case.
Amar Thapa was apprehended on January 17, 2025, following a raid at his residence in Kotla Mubarakpur, where 1.516 kg of charas was seized. Despite procedural lapses in furnishing written grounds for arrest, the court held that such lapses are curable and do not automatically entitle the accused to bail unless demonstrable prejudice is shown. The court emphasized that the priority of investigation and broader societal concerns outweigh procedural defects.
The court also addressed the balance between the accused's fundamental rights and the prerogative of the investigating agency, noting that releasing Thapa could jeopardize efforts to trace the drug network's supplier and other involved parties. Justice Kathpalia pointed out that the arrest memo contained adequate reasons for arrest, aligning with substantial compliance under the Constitution of India and the Criminal Procedure Code.
The judgment further highlighted the pernicious effects of drug trafficking on social stability and national security, stressing that drug trade fuels organized crime and terrorism. Consequently, the court found no compelling grounds to grant bail, underscoring the need for stringent measures against drug offenses.
