CPCB and DPCC Directed to Submit Report on Safe Disposal of Misdeclared Goods Lying Idle for Over Four Years


In a significant development, the Delhi High Court has taken a strong stance against the prolonged inaction concerning the disposal of hazardous waste stored at the Inland Container Depot in Tughlakabad, Delhi. The matter, involving the case of Safelogic Freight Agency LLC versus the Union of India, was heard by a bench comprising Justices Anil Kshetarpal and Shail Jain.


The case revolves around a container imported with misdeclared goods, which instead of aluminum, contained plastic trash. The importer, having absconded, left the container lying idle in the yard managed by the Container Corporation of India for over four years. This situation has led to a stalemate between various authorities over the responsibility of disposing of these hazardous materials.


On July 29, 2026, the Court expressed its dissatisfaction with the lack of progress and the evident blame game among the authorities involved. It noted that the dispute seemed more driven by ego rather than substantial legal questions. The Custom Authorities had filed an affidavit indicating that Respondent No. 4 was required to destuff the container and return it to the petitioner, but Respondent No. 4 contended the lack of adequate space for this process.


Subsequently, despite an adjournment of 20 days, as noted in the order dated August 18, 2026, no substantive action was taken by the authorities. Given the hazardous nature of the waste, the Court directed the Central Pollution Control Board (CPCB) and the Delhi Pollution Control Committee (DPCC) to be impleaded as additional respondents. Notices were served to the newly added respondents to ensure their involvement in resolving the issue.


The Court highlighted the critical need for immediate action and directed the chief scientists of CPCB and DPCC to visit the site and submit a detailed report on the safe and lawful disposal of the hazardous goods. This report is expected to be presented to the Court on the next hearing date set for August 24, 2026.


This case underscores the urgent need for streamlined processes and cooperation among authorities to address environmental hazards effectively. The High Court has warned that failure to resolve the matter amicably may result in stringent orders to expedite the disposal process, emphasizing the judiciary's role in enforcing environmental accountability.
