Anubhav Jain faces arrest and property attachment over willful disobedience of court orders; exemplary costs reduced on appeal.


In a significant ruling, the Delhi High Court upheld a contempt order against Anubhav Jain, Director of Jain Shikanji Pvt. Ltd., for willful disobedience of interim injunction orders relating to trademark infringement. The court's decision came after a protracted legal battle between Jain Shikanji Pvt. Ltd. and Satish Kumar Jain over the trademark "JAIN SHIKANJI." The High Court's judgment mandates the arrest of Anubhav Jain and the attachment of his properties, though it reduced the exemplary costs imposed by the lower court.


The legal tussle began when Satish Kumar Jain filed a suit seeking to restrain Jain Shikanji Pvt. Ltd. from using the trademark "JAIN SHIKANJI," alleging infringement and passing off. The Trial Court had issued an interim injunction in favor of Satish Kumar Jain, which was subsequently upheld by the Delhi High Court in March 2023. Despite the injunction, the respondent claimed that Jain Shikanji Pvt. Ltd. continued to use the disputed trademark, leading to contempt proceedings.


The Trial Court found Anubhav Jain guilty of contempt in June 2023, ordering the attachment of his properties for six months and civil imprisonment for eight weeks. Despite appeals, including one to the Supreme Court, Anubhav Jain failed to comply with court directives. His continued defiance prompted the Trial Court to issue fresh arrest warrants and impose exemplary costs of Rs. 5 lakhs, later reduced to Rs. 3 lakhs by the High Court.


Justice Jyoti Singh, presiding over the case, noted that Anubhav Jain's actions demonstrated a lack of respect for the court's authority. Despite offering an unconditional apology and citing stress as a reason for non-compliance, the court found no merit in his explanations. The judgment underscored the importance of respecting judicial orders and the consequences of flouting them.


Counsel for Anubhav Jain argued for the acceptance of the apology and the setting aside of arrest warrants, contending that the non-appearance was unintentional and due to stress. The court, however, dismissed these claims, emphasizing the consistent disregard for court orders and the repeated attempts to circumvent legal obligations.


The High Court's decision reaffirms the judiciary's stance on upholding the rule of law and ensuring compliance with court orders. The case highlights the severe repercussions for individuals and entities that deliberately ignore judicial directives, reinforcing the importance of adhering to legal norms in trademark disputes.
