Delhi High Court Upholds Denial of Age Relaxation for MCD Teacher Recruitment, Distinguishing It from DoE Rules

Court Rules 1980 DoE Age Relaxation Notification Not Applicable to MCD Recruitment Governed by Separate Rules; Petition Dismissed

In a significant judgment dated October 1, 2026, the Delhi High Court (Division Bench) dismissed the petition filed by Ms. Poonam Patwal challenging the Central Administrative Tribunal's order denying her claim for ten years' age relaxation for the post of Teacher (Primary) in the Municipal Corporation of Delhi (MCD). The petitioner, a woman candidate and guest teacher with the Directorate of Education (DoE), had relied on a 1980 Notification issued by the DoE granting age relaxation to women candidates for teaching posts. However, the Court clarified that this Notification does not apply to recruitment conducted by the MCD, which is governed by separate Recruitment Rules.

The petitioner had approached the Tribunal seeking age relaxation to overcome the upper age limit of 30 years prescribed under the MCD Recruitment Rules of 2011 for the post of Teacher (Primary). Although she participated in the selection process after interim orders and scored higher marks than the last selected candidate, her claim was ultimately rejected by the Tribunal. The petitioner then moved the High Court.

The Court emphasized the constitutional and statutory distinction between the DoE and MCD, noting that the MCD is an autonomous local body under Part IX-A of the Constitution of India with its own recruitment framework. The 1980 Notification issued under Rule 43 of the Delhi School Education Rules, 1973, specifically relates to DoE recruitments and was never incorporated or adopted into the MCD Recruitment Rules. Mere continuation of the Notification until 2020 does not extend its applicability to MCD recruitments.

The Court also relied on Supreme Court precedent in Delhi Subordinate Services Selection Board v. Seema Kapoor (2021) which held that age relaxations or concessions cannot be extended beyond the explicit language of the relevant recruitment rules or advertisement. The Court rejected the petitioner's argument that the MCD post is a feeder post for DoE promotions and that this connection should grant her the same relaxation as DoE employees.

Further, the Court held that participation in the recruitment process pursuant to an interim order does not create substantive eligibility or appointment rights. Even a higher score than the last selected candidate is irrelevant if the eligibility conditions such as age limits are not met.

The Court dismissed the petitioner's claim under Articles 14 and 16 of the Constitution regarding discrimination, holding that distinct recruitment rules for separate autonomous bodies do not amount to hostile discrimination. It also rejected administrative necessity or vacancies as grounds to override statutory eligibility.

In conclusion, the Delhi High Court upheld the Tribunal's order, clarifying that the petitioner was not entitled to the 10-year age relaxation notification of 1980 for MCD recruitment. The writ petition and connected applications were dismissed.

This judgment reinforces the principle that recruitment rules specific to an autonomous body like MCD govern eligibility criteria and age relaxations, and executive notifications issued under a different regulatory framework cannot be imported unless expressly adopted.

Bottom Line:

Service Law - Age relaxation for recruitment to MCD post cannot be claimed on basis of DoE Notification dated 01.11.1980 when post is governed by separate MCD Recruitment Rules and advertisement does not provide such relaxation.
