The Court recognizes the Mizoram Government's efforts to set up the State Human Rights Commission, directs exploration for permanent accommodation.


In a significant development, the Gauhati High Court has closed a Public Interest Litigation (PIL) filed by the Zofa Welfare Organization, which sought the establishment of a State Human Rights Commission in Mizoram as per the mandates of The Protection of Human Rights Act, 1993. The PIL, numbered 4 of 2021, was adjudicated by a division bench comprising Justice Nelson Sailo and Justice Shamima Jahan.


The petitioner, represented by Advocate Ms. Rosalynn L. Hmar, had urged the court to issue directions to the State of Mizoram for setting up the Commission, emphasizing the need for safeguarding human rights in the region. Responding to the PIL, the State Government, represented by Government Advocate Ms. Vanneihsiami and Central Government Counsel Ms. Zairemsangpuii, demonstrated compliance with the directives of the Apex Court in the 2015 judgment of Shri Dilip Kumar Basu v. State of West Bengal and Ors., which mandated the establishment of such commissions across all states.


The court was apprised that the State Government had already made considerable progress. A Chairperson and two members have been appointed for the Commission, as per Notification Memo No. A-12023/3/2026-HM (MSHRC) dated July 8, 2026. Additionally, the Finance Department has allocated substantial funds, amounting to Rs.395.72 lakhs for salaries and operational expenses, with an additional Rs.18.83 lakhs designated for renovating the Urban Resource Centre for temporary accommodation of the Commission.


Justice Nelson Sailo, acknowledging these efforts, noted that the purpose of the PIL had been substantially served. However, the bench emphasized the importance of securing permanent accommodation for the Commission to ensure its effective functioning. The State Government was directed to explore options for a permanent building to house the Commission.


With these observations, the court concluded the proceedings, expressing confidence that the Mizoram Government would continue its efforts to operationalize the State Human Rights Commission without undue delay.
