In a significant judgment, the Gujarat High Court has enhanced the compensation awarded to the families of two deceased individuals involved in a tragic motor vehicle accident. The unfortunate accident, which occurred on June 16, 2004, involved a collision between a truck and a motorcycle, leading to the deaths of the motorcycle rider and the pillion rider. Both victims' legal heirs had initially sought compensation, but the awarded sums were contested, leading to appeals in the Gujarat High Court.
The Division Bench, comprising Mr. N.S. Sanjay Gowda and J. L. Odedra, reviewed the case, focusing on the determination of compensation based on prospective income, loss of consortium, and other non-pecuniary damages. The court noted the necessity of including future prospects and applying the multiplier method as outlined in the Supreme Court's directives.
In the case of the motorcycle rider, who was a contractor with a documented monthly income, the court increased the net monthly income to Rs. 12,150 after tax deductions. The compensation was further enhanced by considering future income prospects at 40% and including additional sums for loss of consortium, loss of estate, and funeral expenses. The total compensation for the rider’s heirs was thus revised to Rs. 27,97,428, up from the initial award of Rs. 24,86,850.
For the pillion rider, a government employee, the court maintained the salary figure established by the tribunal but added 50% for future prospects, acknowledging the secure nature of government employment. The revised compensation, which also accounted for non-pecuniary damages and medical expenses, amounted to Rs. 18,31,250, marking a significant increase from the original Rs. 14,66,500.
The court ordered that the enhanced compensation amounts carry an interest of 9% per annum from the date of the respective claim petitions until realization. The insurance companies involved are mandated to deposit these amounts within eight weeks, ensuring the claimants receive their due compensation promptly.
This judgment underscores the judiciary's commitment to ensuring fair compensation for victims of road accidents, adhering to established legal precedents to protect the rights of the bereaved families.
