Court Validates Military Land Register as Conclusive Proof Despite Discrepancies in Acquisition Records
In a significant judgment, the Karnataka High Court, comprising Justices D.K. Singh and H. Shanthi Bhushan, has affirmed the Defence Department’s title over a disputed land in Sonnappanahalli Village, Bengaluru, dismissing the claims of private ownership. The case, Union of India v. Mohsin Sharieff, revolved around the title of land acquired for the Indian Air Force in 1943, crucial for its taxi track.
The court scrutinized discrepancies in land acquisition notifications that initially omitted the survey number 33, which was later identified as Defence land. The bench emphasized that boundaries, contemporaneous records, and entries in the Military Land Register (MLR) clearly established the Defence Department’s title. The MLR, as a public document, carries a presumption of correctness under the Bharatiya Sakshya Adhiniyam, 2023, which was pivotal in the court’s decision.
The legal battle began when Mohsin Sharieff claimed ownership based on a sale agreement and subsequent civil court decree. However, the court ruled that any transactions following the acquisition were void, adhering to the legal maxim "nemo dat quod non habet," meaning one cannot transfer a better title than one possesses.
The judgment underscored the significance of strategic defence land, dismissing the writ petition filed by Sharieff, and set aside previous orders favoring him. The court granted the Defence Department the liberty to establish its title in the competent civil court, reaffirming the importance of national security interests over private claims.
