Dhaval @ Bobo Gopalbhai Machi Released on Stringent Conditions After Being in Custody Since October 2025


In a significant judgment, the Gujarat High Court has granted bail to Dhaval @ Bobo Gopalbhai Machi, who was accused of coordinating an assault and acting as the primary perpetrator in a case registered under the Bharatiya Nagarik Suraksha Sanhita, 2023. The applicant had been in custody since October 5, 2025, and a charge sheet had already been filed against him.


Presiding Judge, Mr. Nikhil S. Kariel, assessed the circumstances surrounding the case, including the applicant’s antecedents and the completion of the charge-sheet filing, to determine the appropriateness of granting bail. The court acknowledged that the applicant had a history of previous legal issues, noting ten antecedents, though he had been acquitted in the majority of these cases. In one instance related to the Gambling Act, a fine was imposed, and in a serious offense under Section 307, the applicant had been previously granted bail.


The judgment emphasized the need for stringent conditions to ensure compliance and prevent misuse of bail, citing the Supreme Court's precedent in Sanjay Chandra v. Central Bureau of Investigation. Conditions imposed on the applicant include furnishing a bond of Rs. 1,00,000/- with one surety, surrendering his passport, and marking monthly presence at a police station. Additionally, he is barred from entering Anand District for six months and must not leave Gujarat without court permission.


The court's decision to grant bail is pivotal given the context of the allegations and the applicant’s custody duration. It reflects a balance between safeguarding the rights of the accused and ensuring that justice is not compromised.
