Prayagraj, Jul 12 The Allahabad High Court has sought a reply from the Uttar Pradesh government on a writ petition alleging that the petitioner was facing threats after he refused to lodge a false case against Swami Avimukteshwaranand Saraswati under pressure from Ashutosh Brahmachari.
Brahmachari, who had earlier filed a complaint against Saraswati, had said in June that he had filed a “fake suit” under pressure from Ramchandra Das, the mahant of Deva Ashram in Mathura.
The petitioner before the high court, Ramashankar Dixit, also alleged that when he refused to budge under pressure, he was threatened with dire consequences.
The petitioner has also sought protection from police and moved the high court seeking passing of appropriate direction in this connection.
A two-judge bench comprising Justice JJ Munir and Justice Indrajeet Shukla also directed to implead Brahmachari as respondent in the writ petition.
In addition to it, the court also directed the registrar (compliance) to communicate this order to the Inspector General of Police, Bareilly zone, the Superintendent of Police, Shahjahanpur and the SHO of police station Sadar Bazar, Shahjahanpur through chief judicial magistrate of Bareilly and Shahjahanpur.
Accordingly, the court in its order on July 9 directed to list this case on July 16 for the next hearing.
Brahmachari is also one of the plaintiffs in the Shahi Idgah-Krishna Janmabhoomi dispute case of Mathura pending before Allahabad High Court.
Further, acting on Brahmachari's application, a special POCSO court in Prayagraj had directed the police to register a case of sexual assault against the 56-year-old Saraswati and others.
In the present writ petition, Dixit alleged that it was on February 18, 2026, three unknown persons allegedly asked him to get Saraswati implicated in a fake case and offered him money.
The petitioner said that when he refused to do so, they threatened to eliminate him.
According to petitioner, when he approached the police administration, some policemen were posted at his residence as a security measure. However, these policemen allegedly tried to influence him to change his statement.
Thereafter, he again approached the police authorities concerned with complaint but no effective step has been taken so far.
Hence, he had no option left except to file the present writ petition before the high court.
In the writ petition, he has alleged threat to his life and sought protection.
