In a significant ruling, the Jammu & Kashmir and Ladakh High Court has quashed the preventive detention order against Adnan Rasool Ganie, who was detained under the Prevention of Illicit Traffic in Narcotic Drugs and Psychotropic Substances (PIT NDPS) Act, 1988. The court, presided by Justice Rahul Bharti, delivered the judgment on July 13, 2026, citing an unexplained delay in the issuance of the detention order as the primary reason for its decision.
Adnan Rasool Ganie, represented by Advocate Mr. Tawheed Ahmad Sofi, had been in custody since July 24, 2025. The detention order in question, No. DIVCOM-K/128/2025, was issued by the Divisional Commissioner, Kashmir, on July 21, 2025, based on a dossier prepared by the Senior Superintendent of Police (SSP), Srinagar, dated March 4, 2025. The court highlighted that the delay of over four months in issuing the detention order was not justified and violated the principles of preventive detention under the PIT NDPS Act, rendering the order arbitrary and illegal.
The court emphasized that the unexplained time gap between the preparation of the dossier and the issuance of the detention order undermined the very purpose of the Act, which aims to prevent potential threats related to drug trafficking. Consequently, the detention order and its subsequent confirmation by the Government of the Union Territory of Jammu and Kashmir were declared void.
In light of this decision, the court ordered the immediate release of Adnan Rasool Ganie from custody, restoring his personal liberty. The Superintendent of the concerned jail has been instructed to ensure his release without delay.
