Court Orders Payment of Interest, Penalty, and Funeral Expenses under Employees' Compensation Act, 1923
In a significant judgment, the Jharkhand High Court has modified the compensation awarded to the family of Laxman Mandal, a deceased employee, under the Employees' Compensation Act, 1923. The court, presided over by Justice Sanjay Kumar Dwivedi, has directed that the compensation must include interest from the date of the accident, a penalty for delayed payment, and funeral expenses.
The case arose from a tragic accident on May 26, 2012, when Laxman Mandal sustained fatal injuries while unloading stone chips from a truck. The truck, driven negligently, overturned, leading to his demise. Despite a compensation award of Rs. 5,83,270 by the Labour Court, the absence of provisions for interest, penalties, and funeral expenses prompted an appeal by Sudama Devi, the deceased’s widow.
Justice Dwivedi ruled that interest should be applied from the date of the accident, emphasizing the beneficial nature of the Employees' Compensation Act, which aims to protect workers and their families. The court also imposed a 50% penalty on the awarded compensation due to the employer's failure to pay within the stipulated period.
Furthermore, the court granted Rs. 5,000 as funeral expenses, modifying the earlier award to address the appellant's grievances comprehensively. The Insurance Company, which contested the penalty and interest, was directed to comply with the revised compensation structure.
The judgment underscores the legal obligations of employers under the Employees' Compensation Act, highlighting the necessity for timely and adequate compensation to the dependents of deceased employees.
