The judgment came in response to a petition filed for the modification of an order dated March 26, 2014, in which anticipatory bail had been granted to Chandra with conditions that were deemed excessively burdensome.
The petitioner, represented by Advocate Mr. K.K. Ojha, had been directed in 2014 to pay Rs. 35,000 each to three individuals, along with a bank draft of Rs. 23,000 for another individual, as a condition of his anticipatory bail. However, Chandra was unable to meet these financial requirements, preventing his surrender before the court within the stipulated timeframe.
Acknowledging the statutory nature of the bail granted, the court noted that the conditions imposed were not only onerous but also frustrating to the purpose of granting bail. The court highlighted that the imposition of bail conditions is a matter of judicial discretion and should be based on sound judicial principles rather than being arbitrary or mechanical. Justice Dwivedi stated that conditions which are inherently onerous effectively negate the grant of bail, rendering it an exercise in futility.
With the petitioner now able to arrange the necessary funds, the court has allowed an additional two weeks for Chandra to surrender before the learned court. The ruling modifies the earlier order to the extent of extending the compliance period, while the rest of the conditions remain unchanged.
